Executive Order on Modernizing Regulatory Review, Section 2(e)

On April 6, 2023, the Biden administration released a set of reforms to modernize the regulatory review process and make it work more effectively in the public interest. One of the reforms, the Executive Order on Modernizing Regulatory Review (EO), improves and modernizes the regulatory process in numerous ways, such as by broadening public participation, considering the nonquantifiable impacts of rules, and taking seriously the distributional and equity impacts of rulemaking.

Section 2(e) of the EO addresses EO 12866 meetings, which are meetings that members of the public can request with OIRA officials about regulations under review. A document titled “Draft Guidance Implementing Section 2(e) of the Executive Order of April 6, 2023 (Modernizing Regulatory Review)” was open to public comment submissions from April 6 to June 6, 2023 on the website Regulations.gov.
